HC orders swift implementation of policy to curb unnecessary C-sections

The High Court has directed the authorities to swiftly implement the policy aimed at preventing unnecessary C-sections at private and public healthcare facilities across Bangladesh.

The court called for necessary steps to be taken within six months of the formulation of guidelines to regulate the surgical prodecure during childbirth in response to a writ petition. It has also asked for the matter to be publicised widely.

The panel of Justice Naima Haider and Justice Kazi Zinat Hoque issued the directive in light of a rule asking why the government's failure to set out effective guidelines to stop unnecessary C-sections should not be declared illegal, according to Barrister Rashna Imam, who represented the petitioner.

Additionally, the court incorporated the health ministry's policy in its judgment, thereby giving it legal effect, she said.

The High Court had issued the rule on Jun 30, 2019, while ordering the formation of a committee consisting of experts and stakeholders to formulate a policy framework to prevent unnecessary C-sections.

The writ petition was filed by Supreme Court lawyer Syed Sayedul Haque Suman. Citing newspaper reports, the petition highlighted the fact that 77 percent of C-sections performed in hospitals and clinics in 2018 were deemed unnecessary.

The petition pointed out that in most instances, hospital and clinic authorities pressure expectant mothers into undergoing C-sections for financial gain.
