The Chamber Court has stayed the bail granted by the High Court to Mahmudul Hasan Mohin, a "Jubo Dal leader" and the prime suspect in the murder case of scrap metal dealer Lal Chand, also known as Sohag, who was beaten to death with concrete blocks in broad daylight in Dhaka’s Mitford area.
Chamber Judge Justice Md Rezaul Haque passed the order on Sunday after hearing a state petition challenging the High Court’s bail order.
On Sept 28, a High Court bench comprising Justice Md Ruhul Quddus and Justice Syed Hasan Zobair granted Mohin six months’ interim bail.
The court also issued a rule asking why he should not be granted permanent bail.
Deputy Attorney General Syeda Shajia Sharmin said the High Court granted Mohin interim bail on the grounds that there were no specific allegations against him.
Although the bail was granted on Sept 28, the matter came to light on Thursday.
Lawyer Mohammad Asaduzzaman argued for Mohin in the High Court.
Asked about the state’s next steps after the bail was granted, Attorney General Md Ruhul Quddus Kazal told reporters that the state would file a leave-to-appeal petition with the Appellate Division seeking a stay on the bail order.
On Sunday, the Chamber Court heard the state’s petition and stayed Mohin’s bail.
Allegations Against Mohin
The charge sheet identifies Mohin as the main planner and leader of the killing of Shohag.
According to the charge sheet, Mohin and Sarwar Hossain Titu had been in a dispute with Sohag over control of the scrap business and dominance in the area. As part of the dispute, Shohag’s business warehouse had been locked up.
According to the charge sheet, around 5:40pm on Jul 9, the accused went to Shohag’s business premises carrying sharp machetes, plastic pipes, iron rods, sticks, concrete blocks, bricks and pieces of stone.
During an argument between Shohag and Titu, the accused allegedly dragged Shohag out of the shop and began beating him.
Shohag was later dragged to inside Gate No. 3 of Mitford Hospital. The charge sheet says he was beaten indiscriminately and repeatedly struck on the chest, head and face with pieces of concrete.
The charge sheet further says Mohin and Sarwar were present at the scene, directed the others to beat Sohag and led the attack throughout. After confirming Shohag’s death, they allegedly walked around his body with their followers and chanted slogans.
Charge Sheet Against 21
Five months after Sohag was killed in front of Mitford Hospital, police submitted a charge sheet against 21 people in court on Dec 8. They recommended that 10 others be discharged as no evidence of their involvement in the incident was found.
Investigating officer and Kotwali Police Station Inspector Md Moniruzzaman said, “We found evidence against 21 accused after investigating the case. We submitted the charge sheet against them in court on Dec 8. As eight of the accused are absconding, we have sought arrest warrants against them.”
He said, “The witnesses will prove the allegations in the case through their testimony in court. As the allegations could not be substantiated, we have recommended discharging 10 accused.”
The 21 people named in the charge sheet are Mahmud Hasan Mohin, Sarwar Hossain Titu, Monir alias Chhoto Monir, Alamgir, Monir alias Long Monir, Nannu alias Nannu Kazi, Sajib alias Sajib Bepari, Titon Gazi, Tarek Rahman Robin, Apu Das, Rizwan Uddin alias Abhijit Basu alias Abhi, Zahirul Islam, Parvez, Sagar, Ruman Bepari, Abir Hossain, Md Zahir, Imran Hossain, Sharafat alias ShafiuI Islam, Hossain Chowdhury and Ziauddin Raji.
Of the 21 accused, Md Zahir, Md Imran, Md Sharafat alias Shafiul, Md Ziauddin Rajib, Hossain Chowdhury, Sarwar Hossain Titu, Monir alias Long Monir and Apu Das are absconding.
Meanwhile, police have recommended discharging Rajib Bepari, Saba Karim Lucky, Kalu alias Volunteer Kalu, Rajab Ali Pintu, Sirajul Islam, Himmat Ali, Anisur Rahman Howlader, Mizan, Naim and Riyad from the case.
How the Killing Happened
According to case documents, 39-year-old Shohag was hacked with sharp weapons and repeatedly beaten with bricks and stones by a group of assailants in public on Rajani Ghosh Lane near Mitford Hospital on Jul 9 last year.
The charge sheet says Shohag was killed by striking him on the head and body with a concrete boulder in front of Gate No. 3 of Mitford Hospital over a business dispute and previous enmity.
After confirming his death, the accused allegedly celebrated by chanting, “There is no place for extortionists in my golden Bengal,” according to the charge sheet.
A video of the killing spread on social media, sparking widespread discussion across the country.
The day after the incident, Shohag’s elder sister Manjuara Begum filed a murder case with Kotwali Police Station, naming 19 people and accusing another 15 to 20 unidentified individuals.
Expressing dissatisfaction with the police charge sheet, Sohag’s sister Manjuara Begum said, “Muzaffar Hossain Babul, Rakesh and Kayum Molla were the masterminds behind my brother’s murder. But their names are not in the charge sheet. I had also named them in the first information report. Later, I found that their names were missing. Their names were removed while the FIR was being prepared at the police station.”
Following the investigation, the court framed charges against 21 people and ordered their trial on Jul 12 this year at the First Additional Metropolitan Sessions Judge’s Court in Dhaka.
