Dhaka, Mar 6 (BDNEWS) – The Appellate Division Sunday permitted Idrisur Rahman, a lawyer of the Supreme Court, to file an appeal petition against a High Court order, which had declared removal of Syed Shahidur Rahman, an additional judge of the High Court division, from his office illegal.
Advocate Idrisur Rahman will file the appeal as public interest litigation in the Supreme Court Monday.
After hearing a petition filed by Idrisur Rahman seeking permission for filing an appeal against the High Court order, the full bench of the Appellate Division led by Chief Justice Syed JR Mudassir Husain passed the order permitting him to file the appeal.
Dr Kamal Hossain and Barrister Rokanuddin Mahmud moved for the petitioner.
Advocate Rahman, on March 2, had sought permission to file an appeal as public interest litigation against the HC verdict on Shahidur Rahman, but the Registrar office of the SC rejected it on the ground that the lawyer is not a party to the case.
The lawyer, then, had mentioned the matter before the chamber judge of the Appellate Division.
Chamber judge Justice Amirul Kabir Chowdhury had sent the matter to the full bench of the Appellate Division for hearing.
The President had removed Syed Shahidur Rahman, additional judge of the HC, on April 20 last year as per recommendation of the Supreme Judicial Council, which had accused him of gross misconduct.
Syed Shahidur Rahman last year had filed a writ petition in the High Court challenging the validity of the President's order removing him from the office. The High Court issued a rule upon the government to show cause as to why the removal order of Shahidur Rahman from his post should not be declared illegal.
The court in January this year declared the president's order illegal. Shahidur Rahman has already filed an application to the Chief Justice to allocate him a bench in the High Court.
