The court issued the warrants against DOM-INNO Chairperson Rizwana Islam and its Managing Director Abdus Salam for disregarding an earlier court order in a cheating case against them.
Plaintiff's lawyer Mahmudul Hasan said that the court order issued on Oct 10 has been conveyed to the Banani Police Station on Sunday.
The court has issued the order against the duo for dishonouring court order to appear before it in a case of breach of commitment and harassment.
A Banani resident, 'Shamsuddin', moved to the court after an equal ownership contract with the real estate developer on his Banani plot was allegedly violated by the developers.
The contract specified that DOM-INNO would pay a rent of Tk 2 million per month in the event of the apartment not being completed on time.
As per the terms of the contract, the developers were supposed to handover the flat to the plaintiff by July 13, 2013 as Shamsuddin vacated and handed over the plot to the construction company on July 14, 2010.
However, when DOM-INNO failed to complete the project on time, Shamsuddin demanded compensation to the tune of Tk 30.20 million from the company on Dec 5, 2013 and again on Oct 25 last year.
Upon a GD entry against them, the builders paid Tk 4.7 million and promise to pay the remaining amount with a mutually agreed time.
But when the builders failed again to pay the money within the stipulated time, Shamsuddin filed a case against the builders under sections 19, 27 and 30 of the Real Estate Development and Management Act 2010 with Dhaka Metropolitan Magistrate Court of Judge Nuru Mia on Mar 14.
The judge ordered the Banani OC to investigate the matter the same day.
Investigating Officer Wahiduzzaman submitted the investigation report which found the allegations against the builders to be true.
Shamsuddin's lawyer Mahmudul Hasan said that several cases are registered against the builder and that the court has ordered a prohibitory order on sale or transfer of any property by the group.
