Dhaka, Dec 26 (BDNEWS) – The Supreme Court Bar Association (SCBA) Monday sent a letter requesting the President to rescind the order by which Justice Faisal Mahmud Faizee was appointed an additional judge of the High Court.
Earlier, on May 30, the SCBA requested the President to take step to solve the disputes on the certificate and ages of Justice Faizee.
The President, on June 30, had asked the secretary to the Law, Justice and Parliamentary Affairs ministry to take necessary steps to end the disputes. But, the SCBA is not informed whether the ministry has taken any step or not.
In the letter the SCBA secretary advocate M Enayetur Rahim said Justice Faisal Mahmud Faizee did not have original certificate of LLB pass during his taking oath as a High Court judge and he received the enrolment certificate from the Bangladesh Bar Council, the statutory body of the lawyers, by providing 'false information about his age'.
Justice Faizee was given reception by local 'Jamaat-BNP leaders and workers' under the banner of Dantmara Madrasa Committee of Fatikchhari upazila of Chittagong on September 9.
"The incident of receiving reception by Faisal Mahmud Faizee from political elements is unprecedented. Faizee's involvement with political leaders and disputed activities has tarnished the image and dignity of the judges and judiciary. Running judicial functions by a person who has no certificate is tantamount to contempt of court," he commented.
He also said there is no alternative to his resignation for protecting the dignity and image of the Supreme Court.
The lawyers' body of the apex court, on September 12, sent a letter requesting the President to rescind the order by which Justice Faizee was appointed an additional judge of the High Court and also requested the Chief Justice not to allocate any bench to him for his 'disputed activities'.
The SCBA has been boycotting Justice Faizee's bench from October 30, 2004, and demanded Faizee's resignation.
Bangladesh Bar Council, on April 24, cancelled the enrolment certificate (Advocate ship certificate) of Justice Faizee "for taking his certificate by providing false information to the Bar Council".
Justice Faizee did not hold any hearing till April 10 this year from October 2004 as the Chief Justice had not allocated him bench following the SCBA's agitation programmes against him.
