Dhaka, April 25 (BDNEWS) – The Supreme Court Monday stayed for six months a High Court order that had declared illegal the President's order removing Syed Shahidur Rahman from the office of additional judge of the High Court division.
As per the recommendation of the Supreme Judicial Council, the President on 20 April 2004 removed Syed Shahidur Rahman for committing misconduct.
The full bench of the Appellate Division led by Chief Justice Syed JR Mudassir Husain passed the order granting the leave to appeal filed by Advocate Idrisur Rahman against the High Court order.
The appeal hearing may be held on April 27.
After hearing a writ petition filed by Syed Shahidur Rahman challenging the validity of the Presidents order, the High Court, on February 2 this year, declared Shahidur's removal illegal.
Advocate Idrisur Rahman, a Supreme Court lawyer, filed the leave to appeal against the High Court order in the Supreme Court.
Dr Kamal Hossain assisted by Barrister Tanjibul Alam and Barrister Sarah Hossain moved for the petitioner before the court while Azmalul Hossain QC for Syed Shahidur Rahman.
