ACC lawyer Khurshid Alam Khan appealed to the bench of Justices Md Moinul Islam Chowdhury and JBM Hassan on Wednesday to be made a party to the rule on a petition filed by Zubaida.

The ACC appeal would be heard on Thursday, Khurshid said quoting court officials.

He said the hearing on the case got stuck due to the rule.

“We want a hearing on the rule. One has to be included as a respondent if he or she wants a rule to be heard. So we’ve petitioned to be a party,” he said.

The ACC filed the case against former prime minister Khaleda Zia’s elder son Tarique, Zubaida and his mother-in-law Syeda Iqbal Mand Banu on charges of concealing information on assets with Kafrul Police Station on Sep 26, 2007.

Tarique faces charges of earning around Tk 48.2 million from undisclosed sources and concealing information on the assets.

Tarique’s wife and mother-in-law were sued for assisting him and concealing information.

According to the case detail, Zubaida received two fixed deposit receipts (FDR) worth Tk 3.5 million from Tarique.

The ACC filed the chargesheet on Mar 31, 2008.

Following a petition by Zubaida, the High Court stayed the case for two months on Apr 8, 2008.

The ACC’s appeal to withdraw the stay was rejected, bringing the hearing on the case to a standstill.

The ACC was not made respondent in the rule.
