Dhaka, Feb 27 (bdnews24.com) – Late Awami League leader Abdur Razzaq's son Nahim Razzaq is going to be uncontested MP of Shariatpur-3 constituency as the chamber judge of the Appellate Division stayed on Monday a High Court order.
Justice Syed Mahmud Hossain issued the stay order following an appeal by the Election Commission (EC) against the High Court order that had declared valid the candidacy of the only other contestant, T I M Mohitul Gani.
The EC can now declare Nahim elected, deputy attorney general Khandker Dileeruzzaman told bdnews24.com.
"The Election Commission was going to declare him elected uncontested. There is no bar to it as the High Court order has been stayed," he added.
The High Court on Sunday ordered the EC to allow Mohitul to take part in the by-election, scheduled for Mar 15.
The court also put on hold a decision of the returning officer to cancel the candidature of Mohitul contesting under the banner of Nagorik Committee, and also scrapped an appeal against the cancellation order.
It issued a ruling asking the EC why the cancellation of his candidature should not be declared illegal.
The EC had cancelled the nomination paper of Mohitul on Feb 19, saying that inconsistency and error were found in the list of signatures of one percent voters of the constituency.
The Shariatpur-3 parliamentary seat fell vacant after the death of the ruling Awami League lawmaker Razzaq on Dec 23 last year.
