Writ petition seeks to unseat Noakhali MP Hannan Masud over 'affidavit irregularities'

The petitioner alleges the Noakhali-6 lawmaker concealed information and committed fraud in his election affidavit

A writ petition has been filed with the High Court seeking an order declaring the Noakhali-6 parliamentary seat vacant over allegations that MP Abdul Hannan Masud concealed information and committed fraud in his election affidavit.

Nazmul Hossain, a voter and resident of Hatiya Upazila, filed the petition with the relevant High Court section on Wednesday. The petition is dated Jul 30.

Supreme Court lawyer ABM Ibrahim Khalil filed the writ on his behalf.

Khalil said the petition was listed for hearing before a High Court bench of Justice Razik-Al-Jalil and Justice Debasish Roy Chowdhury on Wednesday.

If it is not heard during the day, the matter could come up on Sunday, he added.

Explaining the grounds for the petition, Khalil said questions had been raised over Masud’s declaration of property worth Tk 10 million in his affidavit.

“Abdul Hannan Masud was a student. He went from being a student to a coordinator, then through the quota movement and eventually to parliament,” the lawyer told bdnews24.com.

“Despite being a student, he declared ownership of property worth Tk 10 million in his affidavit, which has raised questions. On Jun 8, he himself admitted that the information had been provided only for show.”

Khalil argued that a member of parliament could not remain in office without “transparency, credibility and legitimacy”, saying the alleged legal irregularities and lack of transparency formed the main grounds of the petition.

The petitioner has sought three forms of relief from the court.

“We have first sought an order declaring the Noakhali-6 seat vacant. Second, we have sought a rule asking why his membership of parliament should not be cancelled, why action should not be taken against him and why the matter should not be investigated," said Khalil.

“Third, we have asked for an order directing the relevant authorities to dispose of our applications submitted to the Election Commission, Parliament Secretariat and other offices.”
