The High Court has ordered Hasina Islam, acting head teacher of Berakola Abdul Matin Khasru Girls High School in Cumilla’s Brahmanpara, to continue in her position.
At the same time, the court has ordered temporarily suspended headteacher Aminul Islam not to enter the school premises.
A bench comprising Justice KM Kamrul Kader and Justice Fatema Anwar issued the order on Tuesday.
Aminul Islam was summoned to appear before the court that day, where he admitted to violating the High Court’s order and begged pardon.
Earlier, the court had said it would sentence him to one month in jail.
However, after he apologised and pledged to comply with court orders in the future and not go near the school, the court spared him from imprisonment.
Hasina’s lawyer, Khwaja Tanvir Ahmed, told journalists that despite the High Court’s order, Aminul had gone to the school and continued working as headteacher.
A contempt of court petition was filed against him over the violation.
Allegation of Removal Through a ‘Mob’
In January 2024, following a writ petition filed by Aminul, the High Court issued a rule asking why his dismissal should not be declared illegal.
Lawyer Tanvir said Aminul Islam interpreted the rule as an order for his reinstatement, sent letters to various offices and began going to the school.
At the time, Hasina was serving as the acting head teacher. After the school reopened on Mar 29, 2024, Aminul went to the school with 20 to 30 people and asked Hasina to vacate the head teacher’s chair.
Hasina told journalists that she refused to leave the chair, informing him that she had been given a letter authorising her to perform the duties. She said she was then ordered to be removed from the chair, and several people kicked her and knocked her off it. She subsequently fell ill.
A case was filed with the police over the incident. Aminul was arrested and was released on bail after spending six days in jail.
Hasina later filed an application with the High Court. Tanvir said the court then issued an interim order barring Aminul from being reinstated.
He said that despite the order, Aminul continued going to the school and performing duties as head teacher until September. A contempt of court petition was then filed against him.
Reason For the Dismissal
Hasina said several investigations had been conducted into allegations of forgery related to Aminul’s appointment and found evidence supporting the allegations.
Although he joined the school in 2010, she said he showed his appointment as dating back to 2004.
She alleged that his signature and those of members of the committee had been forged in connection with the appointment.
She said, “There have been three investigations into the matter, and investigations by the district education board and district education officials also found evidence of irregularities in the appointment.”
Aminul was later temporarily suspended over an incident in which the son of the school’s founder was assaulted.
Hasina has been serving as the acting head teacher since 2024.
