Dhaka, Mar 11 (BDNEWS) – The Criminal Procedure of Code (CrPC) is yet to entertain Deoxyribonucleic Acid (DNA) test of the human beings in Bangladesh.
Criminal law expert advocate Anisul Huq Saturday told BDNEWS that though the DNA test is not a matter of the CrPC, the identification of the human being is nowadays taking place through their DNA tests.
"The DNA test is a matter of Evidence Act of 1872. When the Evidence Act was enacted, there was no system of entertaining the DNA test of human beings to prove their identities," he said.
Advocate Anis said process of DNA test should be incorporated as rules in the concerned law in order to prove the identity of the human being in the country.
"The Evidence Act-1872 till now does not cover the DNA test. The DNA test has been introduced in many countries of the world with the progress of science and technology and it is used as a process of identifying the human beings.
In necessity, amendment should be brought in the law to accept the DNA test report," he said.
Referring to the case of abduction and killing of business millionaire and BNP leader of Chittagong Jamaluddin Ahmed Chowdhury, advocate Huq said the DNA test report has proved that the skeleton exhumed by the Rapid Action Battalion (RAB) from a remote forest in Fatikchhari upazila last year is of Jamaluddin.
"It has been primarily proved from the DNA test that Jamaluddin Ahmed Chowdhury was killed after abduction. As per the relevant situation, Jamaluddin was killed while he was in the custody of the miscreants, but through the test it was not proved who had killed him. The DNA test has identified Jamaluddin. The matter of identifying the killers of Jamaluddin depends on the investigation," he said.
Chittagong Police handed over the remains of the slain businessman and BNP leader Jamaluddin Ahmed Chowdhury abducted in July 2003 to his family members on Friday.
The DNA report received on March 6 confirmed that the skeleton exhumed by RAB from Fatikchhari on August 24 last year is of Jamaluddin. The DNA test was conducted at a Singapore hospital.
