Md Babar alias Babu gave testimony on Wednesday in the Speedy Trial Tribunal-4 in Dhaka.
Babu is an employee of a petrol station near Bahadur Shah Park in the Old Dhaka where Biswajit was killed on Dec 9 last year during opposition-sponsored Dhaka siege programme.
He told the court that he was not present there at the time of the incident.

Earlier, he had made a statement before the investigation officer under Section 161 of the Criminal Procedure Code as an eyewitness to the incident.
Biswajit was hacked to death allegedly by activists of Jagannath University unit of Bangladesh Chhatra League, the student affiliate of the ruling Awami League, mistaking him for a pro-shutdown opposition activist.
During Wednesday’s testimony at the court of Judge ABM Nizamul Haque, Babu said he had not come to work on the day of the incident and witnessed the killing.
After his statement prosecution lawyer Rafiqul Islam declared him hostile.
The court fixed Aug 8 as the next date for testimony recording. There are 60 witnesses in the case.
Eight accused were present in the dock during the Wednesday’s recording of deposition.
The investigation officer pressed charges against 21 suspects in the court on Mar 5 and the court framed charges against all of them on May 26.
