A chargesheet accusing 28 people, including former Bangladesh Chhatra League leader, has been filed 15 months after mentally-ill Toffazzal Hossain was beaten to death on suspicion of theft at Fazlul Huq Muslim Hall of Dhaka University.
Additional Superintendent Hannanul Islam of the Police Bureau of Investigation (PBI) submitted the chargesheet to the Chief Metropolitan Magistrate’s Court in Dhaka, said Sub-Inspector Zinnat Ali of the prosecution police.
Complainant Mohammad Amanullah remains unsatisfied with the PBI chargesheet and plans to submit a formal objection, his lawyer Selim Javed said. The court scheduled the next hearing for Mar 10.
The suspects named in the case are Md Jalal Mia, former deputy science and technology secretary of Fazlul Huq Hall branch of Chhatra League and a student of the Department of Physics, Ahsan Ullah alias Bipul Sheikh of the same hall, Al Hossain Sajjad of the Department of Geography, Md Mottakin Sakin Shah of the Department of Soil, Water and Environment, Sumon Mia, Wajibul Alam, Firoz Kabir, Abdus Samad, Shakib Raihan, Yasin Ali, Yamuzzaman alias Yam, Fazle Rabbi, Shahriar Kabir Shovon, Mehedi Hasan Imran, Ratul Hasan, Sultan Mia, Nasir Uddin, Mobashsher Billah, Shishir Ahmed, Mohsin Uddin alias Shafi, Abdullahil Kafi, Sheikh Ramzan Ali Rocky, Rashed Kamal Anik, Moniruzzaman Sohag, Abu Raihan, Redoanur Rahman Parvez, Rabbikul Riyad, and Ashraf Ali Munshi.
Tofazzal, 32, was tortured in the guest room of Fazlul Huq Muslim Hall on Sept 18, 2024.
A video circulating on social media showed Tofazzal being fed dinner before being brutally beaten.
Around midnight, some students took him to Dhaka Medical College Hospital (DMCH), where the doctor on duty declared him dead.
The next day, Amanullah, supervisor of the university’s estate office, filed a case with Shahbagh Police.
After investigation, Inspector Md Asaduzzaman filed a chargesheet on Dec 30, 2024, accusing 21 DU students.
The university administration challenged the probe as “unfair”, leading the magistrate to order a PBI re-investigation.
On Dec 15, PBI filed a new chargesheet against 28 people, adding seven more.
The case details said, “On Sept 18, at 7:45pm, a young man was roaming suspiciously near the gate of Fazlul Huq Muslim Hall of Dhaka University.
“At that time, some students detained him and took him to the guest room of the main building of Fazlul Huq Muslim Hall.
“Accusing him of stealing a mobile phone, they slapped the young man indiscriminately. During interrogation, the victim said his name was Tofazzal.
“Understanding that Tofazzal was mentally ill, he was taken to the hall canteen and fed. Then, he was taken to the guest room of the south building of the hall, his hands tied to the window, and some unruly students beat him with sticks, stumps, and hockey sticks until he became unconscious.”
Tofazzal hailed from Barguna. He did his Master's in Accounting from Government Brojomohun College, Barishal, but did not work due to mental problems.
His cousin Asma Akhter Tania said, “Tofazzal had a happy family with two brothers and parents. Tofazzal’s father died in a road accident eight years ago, and his mother died five years ago.
“His behaviour has been problematic since his mother’s death. At that time, his elder brother, SI Nasir Hossain, used to look after him.
“He also died of cancer last year during Ramadan. Since then, no one has been there to take care of him. He has been wandering around the streets completely crazy.”
Tania said that they tried to take Tofazzal to a mental health centre, but the effort failed.
On the day he was to be taken to Pabna’s mental health hospital, he broke free and escaped. Afterwards, he drifted around, living in different places across Dhaka.
On Sept 25, 2024, the victim’s cousin Asma Akhter filed a case against 15 people, including Fazlul Huq Muslim Hall Provost Professor Shah Muhammad Masum.
The Dhaka Metropolitan Magistrate accepted the complaint and ordered it investigated alongside the university’s case.
