The International Crimes Tribunal is set decide whether formal charges will be brought against Salman F Rahman, an advisor to ousted prime minister Sheikh Hasina, and Anisul Huq, a former law minister, on Jan 12.
On Tuesday, a three-member Tribunal-1 panel headed by Justice Golam Mortuza Mozumder fixed the date for the indictment order in the case involving charges of crimes against humanity.
Police brought Salman and Anisul to the tribunal from jail under tight security in the morning.
The prosecution was led by Chief Prosecutor Tajul Islam, while the defendants were represented by senior lawyer Munsurul Hoque Chowdhury.
Prosecutors told the tribunal that during a curfew period amid the mass uprising in 2024, alleged incitement to “annihilate” protesters had acted as provocation for killings. Following the hearing, the prosecution asked the court to allow the trial to proceed against the two men.
The prosecution completed its arguments on Dec 2, when it sought the formal framing of charges. At that stage, a phone recording allegedly involving Salman and Anisul was played before the tribunal.
On Jan 4, the defence argued that the conversation did not belong to either of the accused and requested that the audio recording be examined by foreign experts. The tribunal rejected the request and ordered that the recording be kept on the case file.
Prosecutors allege that after the phone call, made during protests in July and August, indiscriminate firing and killings took place in Dhaka and other parts of the country.
The defence is seeking the discharge of the accused, contesting claims of liability and incitement related to the alleged crimes.
