The High Court has suspended the Election Commission's decision to scrap the nomination of Mobasher Alam Bhuiyan, the BNP candidate for the Cumilla-10 constituency in the 13th parliamentary election.
As a result, the party leader, who initially filed his nomination papers against the party's decision, can now contest the polls.
The BNP has written to the Election Commission (EC) to give him sheaf of paddy symbol as a candidate for the constituency, said Salahuddin Ahmed, a member of the party's National Standing Committee.
Mobasher also spoke at a BNP election rally in Cumilla’s Suagazi on Sunday night. Party Chairman Tarique Rahman had introduced the sheaf of paddy candidates at the rally.
On Sunday, the bench of Justice Razik-Al-Jalil and Justice Md Anowarul Islam ordered the EC to suspend its decision regarding Mobasher’s candidacy, according to the Supreme Court's website.
Lawyer Zamir Uddin Sarkar represented Mobasher at the hearing, while lawyer Mizanur Rahman represented the Election Commission.
Initially, the BNP nominated Md Abdal Gafur Bhuiyan instead of Mobasher for the seat, which includes Lalmai and Nangalkot Upazilas.
However, Mobasher also submitted his nomination papers. During the verification process, the candidacy of the BNP “rebel” was scrapped on charges of loan default.
Mobasher appealed against the returning officer’s decision, but the EC rejected it. He then filed a petition with the High Court against the EC’s decision.
Meanwhile, Kazi Nur Alam Siddiqui, a candidate of the Bangladesh Cultural Sangskritik Mukti Jote, had appealed to the Election Commission challenging the candidacy of former BNP MP Gafur. On Jan 18, after hearing the appeals of both parties at the Nirbachan Bhaban in Dhaka, the EC decided to scrap Gafur‘s candidacy for concealing information about his dual citizenship.
He also filed a challenge to the EC decision at the High Court, but it dismissed his petition on Jan 22.
