Police have moved a court to show former chief justice ABM Khairul Haque arrested for his alleged connection with an attempted murder and the use of explosives to disperse protesters in Dhaka’s Mohakhali during the July Uprising.
Dhaka's Additional Chief Metropolitan Md Sefatullah set Jul 6 to hear the petition moved by Banani Police Station Sub-Inspector (SI) Saiful Islam, also the investigating officer, on Thursday, said Prosecution Police SI Moktar Hossain.
Justice Khairul was arrested by the Detective Branch in his Dhanmondi home on Jul 24, 2024, and sent to prison later that day after being shown arrested in the murder case of Jubo Dal activist Abdul Kaiyum Ahad.
He has remained behind bars since.
On Tuesday, the High Court granted Justice Khairul interim bail for six months in murder case linked to the 2024 uprising.
At that time, defence lawyer Sayed Ahmed Raza said there were no pending cases against Justice Khairul. “So, for now, there is no legal bar to his release.”
But the latest plea means the former chief justice is currently unable to be released from prison.
According to the case dossier, the protesters were marching to Shahbagh from Mohakhali in the afternoon of Aug 4, 2024.
The protesters were attacked and shot.when they reached the Setu Bhaban. Some hand grenades were also hurled at them.
Nearly 30 people including one named Ujjal Miah were injured in this incident.
Ujjal filed the case under the Explosive Substances Act while incorporating the attempted murder charge.
Khairul served as Bangladesh's 19th chief justice from Sept 30, 2010, to May 17, 2011.
Days before retiring, he headed the Appellate Division bench that declared the 13th Amendment unconstitutional, effectively abolishing the non-party caretaker government system for parliamentary elections.
The Awami League government appointed him Law Commission chairman on Jul 23, 2013, a post he held through multiple reappointments.
He resigned on Aug 13, 2024, a week after the Sheikh Hasina government fell amid the student-led uprising.
