The High Court (HC) has summoned Pravath Chandra Biswas, director general of the Directorate General of Health Services (DGHS), to appear in person and explain the repeated failure to implement court orders over staff recruitment.
A bench comprising Justice Fahmida Quader and Justice Asif Hasan passed the order on Thursday following a hearing on a contempt of court petition.
The DG has been directed to appear before the court on May 19.
Advocate Siddiqullah Mia represented the petitioners during the proceedings.
The case stems from the final results of a recruitment exam for employees under the DGHS, published on Mar 9, 2022.
The results were immediately mired in controversy, with candidates alleging widespread irregularities.
According to Siddiqullah, the recruitment process bypassed merit.
"We proved in court that a candidate who scored 78 was denied a position, while another who scored only 52 was appointed," he said.
"In another instance, a candidate was recruited under the freedom fighter quota despite never applying for it."
More than 25 aggrieved candidates moved the HC challenging the results.
Following a final hearing, the HC ordered the DGHS to appoint the petitioners.
Although the state challenged the appointment order, it drew no stay order.
The DGHS failed to execute the court's directive, prompting the candidates to file a contempt of court petition.
The court summoned the official results for review, and it was discovered that the petitioners were indeed among the top scorers, according to their lawyer.
The court subsequently issued a final directive to appoint the petitioners without further excuses.
"The deadline passed, yet the DGHS did not comply. Furthermore, no representative from the directorate was present during the latest hearing," Siddiqullah noted.
"Since this is a matter of contempt and the court's orders have been repeatedly ignored, we requested the personal appearance of the director general."
