Kamaruzzaman’s defence receives copy of death sentence

The defence of war criminal and death-row convict Mohammad Kamaruzzaman has received the full verdict by the Appellate Division.

The Jamaat-e-Islami leader’s lawyer Shishir Monir confirmed journalists of the receipt of the Nov 3 sentence on Thursday. 

The apex court on Feb 18 published a copy of the full verdict, clearing the way for starting the process of execution of his death sentence.

Apart from Chief Justice Surendra Kumar Sinha, justices Md Abdul Wahhab Miah, Hasan Foez Siddique and AHM Shamsuddin Choudhury signed the verdict.

According to the law, after receipt of the copy and issue of the death warrant, the government can start the process for execution of the sentence.  

The accused, however, has a chance to file a review petition within 15 days from its publication. However, the defence told journalists that they wanted to count the period from the day of receipt. 

The Appellate Division verdict clearly states that duration will be counted from the official announcement of the verdict or receipt of copy, whichever comes first. 

Attorney General Mahbubey Alam also said that since the death warrant had previously been issued, the duration should be counted from the publication of the verdict.  

The war crimes tribunal sentenced to death Jamaat Assistant Secretary General Kamaruzzaman on May 9, 2013. The Appellate Division upheld the verdict on Nov 3 that year.

The accused will be able to seek amnesty from the president. He will also be allowed to meet his family.

But he cannot be hanged before the review petition, if any, is resolved.

Kamaruzzaman is the second convict to see the full verdict on charges of war crimes against him.

The Supreme Court, in the first full war crimes verdict, extended Jamaat Assistant Secretary General Abdul Quader Molla’s punishment from life imprisonment to death sentence.

He was executed on Dec 12 last year.

Jamaat’s second man Delwar Hossain Sayedee’s punishment was lessened from death sentence to life term.
