A complaint has been filed against former West Bengal chief minister Mamata Banerjee over her remarks involving the arrest of suspects linked to the murder of Sharif Osman bin Hadi.

She faces allegations that her statements were provocative, defamatory, and harmful to constitutional institutions.

Advocate Rinki Chatterjee Singh lodged the complaint on Thursday at the Siliguri Cyber Police Station, according to Indian news agency ANI.

In her filing, Rinki alleged that Mamata, through public speeches, political platforms, and media interactions, made “provocative and inflammatory statements” against constitutional institutions of India, including the Election Commission of India and the Central Armed Forces deployed for maintaining law and order during elections, the report added.

“Recently, through various public speeches, political platforms and media interactions, the accused has allegedly made several provocative and inflammatory statements against constitutional institutions of India, including the Election Commission of India and the Central Armed Forces deployed for maintaining law and order during elections. The accused publicly questioned the integrity, neutrality and credibility of such constitutional institutions, thereby allegedly attempting to create public distrust and disaffection against the State machinery,” ANI quoted the complaint.

It also refers to remarks allegedly made on Jun 2 at a political platform in Rani Rashmoni Smarane, where Mamata claimed she had held confidential discussions with India’s Ministry of Home Affairs and linked the central government and union home minister to a political killing in neighbouring Bangladesh.

“Further, on 02/06/2026 (Tuesday), from a political platform at Rani Rashmoni Smarane, the accused allegedly claimed that she had confidential discourse with the Ministry of Home Affairs, Government of India, and further made allegations connecting the Government of India and the Union Home Minister with a political killing in the neighbouring country Bangladesh. Such allegations were allegedly made openly before the public and media with the apparent intention of lowering the image and credibility of the Union Government before the international community and creating hostility between two sovereign nations,” the complaint said.

Although the victim was not explicitly named, the sequence of references indicates the remarks were linked to the killing of Inqilab Moncho leader Hadi in Dhaka in December 2025.

The complaint argues that such statements were intended to damage the credibility of constitutional institutions and undermine public trust in state machinery.

Referring to the case, Mamata said: “A major killer from Bangladesh was arrested by the STF of the state police, which led to significant protests in Bangladesh.

“I do not wish to speak about another country, nor do I have the right to do so. But what I want to say is that those killers entered West Bengal through the Meghalaya border. After arriving in Bengal, our STF arrested them. That was their achievement.

“But then Union Home Minister Amit Shah personally called me and told me to instruct the state police not to let it become public because it concerned the country. Who had arranged the killing? Whose names had emerged? Even though governments have changed today, I know everything.

“My heart is a repository of information. I remained silent for so long. But oppression has crossed all limits, forcing me to speak. I do not want to reveal that name; if I do, Bangladesh will erupt. I love Bangladesh. For the sake of the country, I will not reveal that name.”

Speaking to BBC Bangla, lawyer Rinki said Mamata's remarks could damage relations between India and Bangladesh.

“When Mamata took oath as chief minister, she pledged to protect the country's security, sovereignty and integrity. But her remarks could harm India's relations with neighbouring Bangladesh,” she said.

“India seeks friendly relations with its neighbours. Neither the Bangladesh government nor Hadi's parents have pointed fingers at India in this murder case. Yet Mamata has created a major security risk for the country.

“As a result of these comments, anti-India forces in Bangladesh could become active and minorities in Bangladesh may become vulnerable.”
