SC stays Tangail by-polls after plea to freeze HC order on Kader Siddique’s nomination

The apex court has stayed the Tangail-4 by-polls amid a legal battle between Kader Siddique and the Election Commission (EC) over the Krishak Sramik Janata League (KSJL) chief’s nomination.

The Supreme Court’s Chamber Judge Syed Mahmud Hossain gave the order on Tuesday after hearing the EC’s plea to freeze a High Court ruling, which ordered the acceptance of Siddique’s nomination.

The Chamber Judge forwarded the matter to a regular appeals bench, which will hear it on Nov 2.

The Tangail-4 constituency fell vacant after Siddique’s elder brother and former Awami League minister Abdul Latif Siddique resigned from Parliament last month.

Altogether 10 persons, including four from the KSJL, filed nominations for contesting the by-polls scheduled for Nov 10.

But the returning officer on Oct 13 scrapped four nominations, including that of Kader Siddique, for defaulting a loan repayment.

He moved the EC against the decision, but his plea was rejected after a hearing.

Siddique then, in Oct 21, appealed to the High Court against the decision, and the court ordered the EC to accept his nomination.

The EC filed a plea with Supreme Court’s chamber judge to stay the High Court order, and the matter came up for hearing on Tuesday.
