Deposed prime minister Sheikh Hasina and three of her former ministers have been charged with “planning and criminal conspiracy to commit murder, financial assistance, supplying firearms and giving direct and indirect orders” leading to the murder of CNG autorickshaw driver Md Shobuj in Dhaka's Mohammadpur during the July Uprising.
Former road transport and bridges minister Obaidul Quader, former home minister Asaduzzaman Khan, former textiles and jute minister Jahangir Kabir Nanak and two former members of parliament -- Nurunnabi Chowdhury Shaon and Sadek Khan -- are among the 15 suspects who face the same charges as Hasina.
The remaining 14 suspects among the 30 accused in the case are charged with “directly assisting in the murder”. The investigation officer has said that they have found primary evidence against the accused of the crime of “sparking a riot with a baton charge” and attacking unarmed students and members of the general public engaged in a protest. Most of the suspects are Awami League leaders, ward councillors and Chhatra League leaders and activists.
Although Hasina, Quader and Kamal were not initially named in the case report, the investigation officer, Mohammadpur Police Station Sub-Inspector Md Mazharul Islam, said that they will be included in the charge sheet "as their names came up during the investigation."
He submitted the chargesheet on Nov 27 for presentation to the relevant court in Dhaka. When the chargesheet was presented to the court last on Thursday, Dhaka Metropolitan Magistrate Hasib Ullah Pias "noted" it, said SI Mizanur Rahman of the prosecution department.
However, the court did not make an announcement on receiving the chargesheet or the subsequent proceedings that day.
Investigation officer Mazharul told bdnews24.com that charges have also been dropped against several suspects whose involvement was not apparent during the police probe.
The chargesheet shows that 80 people have been dropped from the case, and the investigation officer has named 46 people as witnesses.
According to the case dossier, 22-year-old CNG autorickshaw driver Shobuj died in the hospital after being shot in front of Moyur Villa in Dhaka’s Mohammadpur on Aug 4, 2024. Monir Hossain, the brother of the deceased, filed a case with Mohammadpur Police Station on Sept 1, naming 98 suspects and accusing another 450-500 unidentified suspects.
THE ALLEGATIONS AND THE ACCUSED
The investigation officer stated the investigation found evidence of the crime of “planning and criminal conspiracy to kill Shobuj, financial assistance, supply of firearms, direct and indirect instructions and advice, and overall cooperation” against 16 people, including Hasina, three former ministers and two former members of parliament.
Based on the information and evidence found during the investigation, he said in the charge sheet, "These accused have dissolved the Awami League party committees in some places because they showed laxity in suppressing the movement. In addition, they held secret meetings several times and instructed the leaders and activists to resist the movement with all their might."
The other 10 accused are former councillor Salimullah Solu of Ward No. 29, former councillor Syed Nur Islam Ruston of Ward No. 32, former councillor Sheikh Mohammad Khokon of Ward No. 34, Dhaka North Awami League President Bazlur Rahman and Organising Secretary Azizul Haque Rana, Mohammadpur Thana Awami League President Abdus Sattar Bhuiyan, Dhaka Metropolitan North Chhatra League President Riaz Mahmud, and Muhammad Badiul Alam Badiuzzaman, Furkan Hossain and Shahjahan Khan.
On the other hand, those charged with “directly aiding” in the murder case are former councillors Asif Ahmed and Tarequzzaman Rajib, Jahangir Kabir Nanak’s Personal Secretary Masudur Rahman Biplob, Mohammadpur Thana Chhatra League President Naimur Rahman Russell, Awami League leaders Anisur Rahman Kabul, Maruful Islam Biplob, Sentu, Monir Chowdhury, Faruk Khan Obi, Abul Kashem Kashu, Shanta Store owner Selim, and Chhatra League leaders Aiman Wasef alias Omik, Kamruzzaman Rubel and Milan Hossain.
SIBLINGS DEMAND JUSTICE FOR ‘SENSELESS DEATH’
After Shobuj's brother and the plaintiff in the case, Monir, learnt that police had filed a chargesheet in the case, he said: "Now I am hoping for justice.”
He told bdnews24.com, "My brother was murdered, though he committed no crime. I want justice. However, I have been saying from the beginning that only those who are truly guilty should be brought to justice. No innocent person should be harassed."
Shobuj's sister Seema, who said her parents fell ill after her youngest brother was killed, said: "Shobuj was the youngest of six siblings. He was loved by everyone. He got married a year and three months ago. He was shot dead, though he committed no crime. Those who killed him should be hanged."
