High Court throws out legal challenge against Maya’s Cabinet post

The High Court has binned a petition challenging the legality of Awami League leader Mofazzal Hossain Chowdhury Maya holding offices of MP and minister.

Justice Syed Refaat Ahmed scrapped the plea after Thursday’s hearing.

The chief justice had forwarded the petition to Ahmed’s bench on Nov 10 after a High Court bench gave a split order on Aug 17.

Defence counsel Sayeed Ahmed Raja told bdnews24.com the court had scrapped the plea saying Maya was “not incapable” of being an MP.

Plaintiff Yunus Ali Akhand moved the court contesting the legality of Maya holding offices on July 7 after the Appellate Division ordered fresh hearings into a corruption case in relation to the Awami League leader.

On June 14, it overturned a 2010 High Court order acquitting Maya of graft charges in a 2007 case.

Maya was charged with owning illegal property worth about Tk 3 million.

He was sentenced to 13 years in prison, fined Tk 50 million and a special court also ordered impounding of his property worth around Tk 60 million.

The High Court order sparked fresh debates about legality of Maya holding offices.

Akhand served a legal notice on him on June 30 and moved the court as the minister did not stand down from the office.

Maya’s counsel Raja said Thursday’s order meant, “Maya’s holding offices is legal”.
