Dhaka, Apr 13 (BDNEWS) – In spite of not being a party in the suo-moto contempt rule against the CEC and Nurul Islam Moni, MP, Attorney General AJ Mohammad Ali Thursday surprisingly defended the BNP lawmaker before the Supreme Court.
Advocate Khandaker Mahbubuddin Ahmed earlier told the Court that none other than the Court and the counsels for the contemnor petitioners can take part in the submission as the Supreme Court itself issued the contempt rule against the CEC and Moni.
The Chief Justice's court, on March 27, issued the suo-moto contempt rule against Justice MA Aziz and Nurul Islam Moni MP, for annexing a letter expressing "lack of confidence on the apex court" along with the leave to appeal filed by the EC against the High Court judgment over preparing electoral roll.
The Attorney General submitted that before the court that Nurul Islam Moni sent the letter to the counsel for the Election Commission (EC) Advocate Khandaker Mahbubudin Ahmed.
He said that Nurul Islam Moni did not utter anything in the letter committing contempt of court in his letter to Advocate Mahbubuddin.
As the AJ tried to read out the letter, the full bench of the Appellate Division stopped him saying that they had already heard the matter.
The Attorney General, on April 10, submitted before the court that he did not receive any notice from the Supreme Court regarding contempt rule against Justice MA Aziz and Nurul Islam Moni.
Then, the Supreme Court showed him the record that one Shaheda, a staff of the Attorney General's office, received the notice.
