Dhaka, Aug 30 (bdnews24.com) – The Appellate Division has stayed a High Court order that halted proceedings of allocating Tk 150 million for local development activities to the relevant MP of Akkelpur constituency.
The vacation bench of justice ABM Khairul Haque gave the order on Monday based on a government petition.
Deputy attorney general Mostofa Zaman Islam represented the state in the hearing.
Earlier on Aug 16, the High Court has asked the government to explain why the decision by the Executive Committee of the National Economic Council's (ECNEC), to allocate Tk 150 million to every MP for local development activities, should not be declared illegal.
The bench of justices Mohammad Anwarul Haque and Syed Abu Kowser Md Dabirush-shan asked the cabinet secretary, prime minister's chief secretary and three others to respond to the order within four weeks.
The court also stayed for four weeks the proceedings for allocating Tk 150 million to the relevant MP of Akkelpur constituency for local development activities.
The HC order came upon a writ petition filed by the Joypurhat Akkelpur Upazila chairman Anwarul Haque Bablu. In his petition he said the ECNEC decision violates Sections 59 and 60 of the constitution.
According to the Sections, locally elected representatives are to be responsible for conducting local development activities.
The ECNEC decided for the allocation on priority basis at a meeting on Mar 10 this year.
