Dhaka, April 23 (BDNEWS) – The High Court Saturday severely criticised Chief Metropolitan Magistrate of Chittagong Ali Noor for sending Hridoynath, a six-month old infant, with his mother, Minati Nath, to jail without granting bail in a dacoity case.
Magistrate Ali Noor, complainant of the case Hazi Mohammad Samiruddin and Investigation Officer (IO), Jahidul Islam stood with their hands folding before the High Court bench about half an hour.
The bench comprising Justice AK Badrul Haque and Justice Fazlur Rahman released Magistrate and IO from personal appearance before the court and fixed May 23 for next hearing of the case.
It was reported in the national dailies that Hazi Mohammad Samiruddin of Nandankanon Golapsingh Lane, Chiitagong, filed a criminal case against four infants, Sagar Nath, Hridoy Nath, Dhananjoy Nath alias Durjoy Nath and Bijoy Nath, along with their parents with Kotwali police station on February 1.
The four infants in the laps of their parents appeared before the CMM court of Chittagong on February 28.
The High Court, on April 2, had issued a rule upon Chief Metropolitan Magistrate of Chittagong Ali Noor to show cause as to why his magistracy power should not be seized for sending Hridoynath, a six-month old infant, with his mother, Minati Nath, to jail without granting bail in the case.
Dr Rafiqur Rahman for Ali Noor, Advocate Nijamul Haque Nasim for Jahidul Islam and Khondker Mahbub Hossain for Hazi Mohammad Samiruddin moved before the court.
