Chinmoy Krishna Das, spokesperson of the Sammilita Sanatan Jagaran Jote, has claimed innocence in the murder case of lawyer Saiful Islam Alif murder case, a stance echoed by other defendants.
The plaintiff and prosecution lawyers argued that the chargesheet, postmortem report, statements, and confessions provide ample grounds for framing charges.
After considering both sides, the court ordered trial proceedings against all 39 suspects on Monday.
At the start, none of the present defendants had legal representation.
Later, reassured by prosecution lawyers and bar association leaders, Chinmoy’s lawyer appeared.
A state-appointed lawyer represented 16 absconding defendants but did not object. One present defendant spoke on their own behalf, while 21 others remained unrepresented.
Among the suspects present, one spoke in court on his own behalf.
No lawyer was present for the remaining 21 accused.
CHINMOY CALLS THE CHARGESHEET “MOTIVATED”
At the start of the hearing, the court asked if any accused had a lawyer.
Rajib Bhattacharya said his family tried, but the lawyers refused.
Chinmoy claimed the process was not properly maintained and the chargesheet was flawed and motivated, noting he was arrested in Dhaka on Nov 25, 2024, taken overnight to DB custody in Chattogram, and brought to court on Nov 26.
He added that throughout the process, media, cameras, and mobile phones were present, including in the courtroom.
He said his statement was not taken during questioning.
THERE IS PRIMA FACIE EVIDENCE OF THE CRIME
At the hearing, Public Prosecutor SUM Nurul Islam said there are 39 accused, 23 in custody and 16 absconding.
The victim, a prominent lawyer, was brutally murdered, he said.
On that day, accused Chinmoy was brought to court, he presented.
When his bail was denied, his followers caused chaos in the courtroom and around the prison van.
His followers attacked police, vandalised vehicles and a mosque, and brutally killed lawyer Alif as he was returning home from court, the lawyer said.
“Three of the accused have given statements under Section 164. The charge sheet contains prima facie evidence for each crime,” said Nurul.
Plaintiff’s lawyer Raihanul Wazed Chowdhury said Alif was murdered in a planned manner and targeted as a lawyer.
He said Alif was hacked 26 times.
Chinmoy’s lawyer claimed he was not provided with statements recorded under Section 164 despite repeated requests.
