The family of metro rail victim Abul Kalam Azad has issued a legal notice demanding Tk 100 million in compensation and permanent employment at the metro rail for one family member.
The notice was sent by post on Tuesday by Enamul Haque Nabin, a lawyer at the Dhaka Judge Court.
Nabin said the authorities have been given 30 days to provide the compensation and employment. Failing this, the family will move for legal action.
Around 12:30pm on Sunday, 35-year-old Azad was walking along the pavement near Farmgate metro rail station when a bearing pad detached from pillar No. 433 and struck his head, killing him on the spot.
Following the incident, and amid public discussion, the government announced Tk 500,000 in immediate financial support for the family, as well as the promise of a job for one family member.
The road transport and bridges ministry also formed a five-member committee to investigate the accident.
Azad’s wife Irin Akhter Pia filed a case at Tejgaon Police Station on Sunday night.
The legal notice accuses the metro rail authorities of gross negligence and mismanagement, outlining the fatal incident in detail.
It notes that Azad was the sole breadwinner of his family, leaving behind his wife and two young children. His younger brother’s education was also funded by him.
“The death of Abul Kalam Azad occurred due to the extreme negligence and mismanagement of the metro rail authorities,” it said.
The statement added that the authority failed to properly maintain their structures and equipment.
“They have long been negligent in operating the metro rail despite defects and public safety risks, leading to the death of Abul Kalam Azad.”
The previously announced government assistance of Tk 500,000 has been described in the notice as “very insignificant, unrealistic, ambiguous, and humiliating”.
Separately, Supreme Court lawyers Tanvir Ahmed and Abdullah Al Mamun filed the two public interest writ petitions on the incident.
On Tuesday, Advocate AM Mahbub Uddin Khokon placed the petitions for hearings before the bench of Justice Fatema Najib and Justice Fatema Anwar.
