Two lawyers have filed writ petitions at the High Court seeking compensation for the family of a man who died after being hit by a falling bearing pad from the Dhaka Metro Rail.

They also called for the formation of an investigation committee to probe the incident.

On Tuesday, Advocate AM Mahbub Uddin Khokon placed the petitions for hearings before the bench of Justice Fatema Najib and Justice Fatema Anwar.

Supreme Court lawyers Tanvir Ahmed and Abdullah Al Mamun filed the two petitions in the public interest.

Mahbub later told journalists that the hearing had been completed, and both petitions would be heard together. The court is expected to issue an order on the matter on Wednesday.

He said the petitions sought rules and directives over negligence by the state and the contracting company, the violation of fundamental rights, mismanagement, compensation for the family of the deceased Abul Kalam Azad, and the formation of a high-powered investigation committee comprising persons outside the railway authorities.

On Sunday, 35-year-old Azad, a pedestrian, died in Dhaka’s Farmgate after a bearing pad from the metro rail fell on him.

The victim's wife, Irin Akter Pia, filed an unnatural death case at Tejgaon Police Station over the incident later that night.

Around 12:30pm that day, Azad was walking along the footpath near the west end of the metro rail station in Farmgate when a bearing pad detached from pillar No. 433 and struck his head, killing him on the spot.

Witnesses said the heavy rubber pad also damaged a roadside tea stall.

Later in the evening, Road Transport and Bridges Advisor Fouzul Kabir Khan said the metro rail authorities will take full responsibility for the victim’s family.

He said, “We will take full responsibility for the victim, meaning the metro rail authorities will do so. Initially, the victim’s family will receive Tk 500,000. In addition, if any family member is able to work, they will be offered a job at the metro rail.”
