The decision was made by a five-member appellate bench led by Acting Chief Justice Md Abdul Wahhab Miah on Thursday.

The High Court had previously scrapped the petition on Oct 22.

The High Court had also issued some observations, stating that two of the witnesses had already been cross-examined by Khaleda’s lawyers. They had not cross-examined the remaining nine, but the cross-examination by the defence team of Khaleda’s son, Tarique Rahman, could be used, they said.

Khaleda’s lawyers sought permission from the Supreme Court to appeal against the decision.

The Zia Orphanage Trust graft case was filed in 2008. The ACC case accuses Khaleda, her son Tarique Rahman and four others of embezzling Tk 21 million.
