Dhaka, Sep 26 (bdnews24.com)—The High Court has scrapped the bail petition by the chairman of a faction of Islami Oikya Jote, Mufti Fazlul Haque Amini, in a sedition case, for making derogatory remarks about the constitution, and ordered him to surrender immediately.
The single bench of justice Khandaker Musa Khaled gave the order on Monday.
Additional attorney general M K Rahman, who is filling-in for the attorney general, said, "the court has ordered Amini to surrender to the lower court immediately."
Lalbagh police filed the case with the Chief Metropolitan Magistrate's Court on Aug 11 over derogatory remarks Amini reportedly made about the constitution. The Islamist leader told a meeting on July 14 that "the constitution should not only be thrown away but thrown into the dustbin".
A day earlier, BNP chairperson Khaleda Zia had said the constitution would be thrown away when her party would come to power.
Earlier, on Aug 25, a two-judge bench of the High Court has given a split verdict on the bail appeal in the sedition case. Senior judge Nazrul Islam Chowdhury ordered him to surrender in the trial court while Md Anwarul Huq threw out the appeal altogether.
The appeal was then sent for resolution to the chief justice, who assigned Khaled's single bench to hear the appeal.
When Amini's lawyer Khandker Mahbub Hossain petitioned for more time on Monday, additional attorney general M K Rahman opposed it saying, "The defendant should be present at court to appeal for anticipatory bail. Amini isn't."
Following the end of the hearing, the court scrapped both the appeal for extending time and the bail petition.
