Freedom fighter Faruk murder: SC stays bail of former AL MP Rana

The Supreme Court chamber justice has stayed the six-month interim bail of former Tangail-3 Awami League MP Amanur Rahman Khan Rana in the case over the murder of freedom fighter Faruk Ahmed.

Chamber Court of Justice Hasan Foez Siddique issued the order on Monday following an appeal by the state.

It has also forwarded the appeal to the full bench of the Appellate Division for a hearing on Mar 31.

Sayeed Ahmed Raja represented Rana at the hearing. Attorney General Mahbubey Alam moved the petition for the stay order by the state. He was assisted by Deputy Attorney General Biswajit Debnath and Md Bashir Ullah.

“The High Court had granted six months’ bail to Amanur Rahman Khan Rana in the case filed over the murder of freedom fighter Faruk on Mar 14,” Bashir Ullah told the journalists.

“The state appealed to the Chamber Court for a stay on the High Court order on Sunday. The chamber justice has stayed the bail order granted by the High Court and forwarded the appeal to the full bench for a hearing on Mar 31.”

On Apr 13, 2017, Rana had received bail from the High Court after several attempts in the case over the murder freedom fighter Faruk. But the order was stayed by the Appellate Division after a state petition.

Later on Oct 19, acting Chief Justice Md Abdul Wahhab Miah kept the stay order on the bail and ordered the rule to be settled within four weeks.

The High Court subsequently scrapped the bail petition and Rana made a fresh appeal to the judicial court.

The judicial court denied Rana’s bail appeal over Faruk’s murder on Sept 5, 2018 and the murder case of two Jubo League leaders on Sept 30. His legal counsels then appealed to the High Court.

The High Court granted six months’ bail to Rana on Mar 6 on the murder of two Jubo League leaders and on Mar 14 on the Faruk murder case.

But the former MP was unable to leave prison as the chamber justice stayed the bail order on the Jubo League leaders murder case on Mar 14.

Faruk Ahmed, a member of the Tangail District Committee of the Awami League was shot dead on Jan 18, 2013. Then MP Rana surrendered over the murder case on Sept 18, 2016 and was sent to jail by the Tangail Judicial Court.

The police submitted a charge sheet against 14 suspects, including Rana and his three brothers, on Feb 3, 2017. The court began the trial on Sept 6 that year. The court is recording the testimonies on the case at present. 

The other case was filed in 2013 over an incident that occurred the year before.

Shamim and Mamun, leaders of Baghi Union wing of the Jubo League in Tangail, went missing from Tangail city on Jul 16, 2012. The next day, Shamim’s mother Asia Khatun filed a general diary with the Tangail Central Police Station.

The father of the missing Mamun filed a murder case at the Tangail Court on Jul 9, 2013 and the police listed the case on Sept 21.

Jahid, Shahadat Hossain and Hiran Mia, the detainees in the case, confessed to the court and mentioned the involvement of Awami League leader Amanur Rahman Khan Rana.

They killed Jubo League leaders Shamim and Mamun and disposed of the bodies in the river as ordered by Rana, the arrestees said.
