Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil issued the rule on Thursday following a writ petition filed by Alam challenging the legality of the case.

Barrister Sara Hossain represented Shahidul and Attorney General Mahbubey Alam represented the state.

On Mar 3, Shahidul filed the writ petition challenging the legality of the case, in which he was behind bars for over three months.

The police arrested Shahidul, founder of the Drik Gallery, Pathshala and the South-Asian Media Institute on Aug 5, over charges of spreading rumours during a campaign for safer roads by students in Dhaka.

Later police filed a case under the ICT act against Shahidul alleging that he had ‘provoked people and spread false propaganda.’

He was released from the jail on Nov 20 last year after the HC granted bail to him on Nov 15.
