Kushtia Islamic University loses appeal, cannot cancel admission test

The Appellate Division has upheld a High Court decision scrapping Kushtia Islamic University’s choice to cancel F Unit admission tests over allegations of question paper leaks.

As a result, about 100 students admitted to the two divisions after the exams can continue their studies, a lawyer involved in the case said.

In April this year, the High Court declared the decision to cancel the entrance exam illegal. The university administration then appealed the case.

An appellate bench led by acting Chief Justice Md Abdul Wahhab Miah declared the verdict in the appeal on Wednesday.

The petitioners were represented by Barrister Ruhul Quddus Kajol. The state was represented by Attorney General Mahbubey Alam.

Two divisions of Islamic University’s F Unit (mathematics and statistics) held their admission exams on Dec 7 last year, Kajol told the media.

One hundred students were admitted to the two divisions on Jan 16 after they passed the test. On Mar 6, 2017 the university’s syndicate held a meeting over allegations of question paper leaks and cancelled the test.

Eighty-eight students challenged the decision in a writ petition to the High Court.

On Mar 13, the High Court stayed the syndicate’s decision and issued a rule.

On Mar 16, however, the university administration held new examinations. The High Court heard the case again on Apr 17 and made the rule absolute, allowing the admission of the initial group of 100 students.

The university administration appealed the decision. The appeal was eventually rejected on Wednesday.
