An Appellate Division Bench led by Chief Justice SK Sinha on Wednesday upheld the capital punishment for Nizami who orchestrated the killing of Bangladesh’s best brains in 1971 through his ruthless militia.

After the verdict, prosecutor Turin Afroz said, “We’re certainly happy. We’re now slowly getting verdicts upholding death penalties for those who murdered intellectuals and committed crimes against humanity.”

Admitting that the prosecution had ‘committed lapses’ she said, “No matter whatever shortcomings we had, the (Appellate Division) verdict is our achievement.”

Different quarters, both within and outside the country, had criticised the prosecution over its handling of trials of war criminals.

Even the International War Crimes Tribunal questioned its efficiencies in handling the Nizami case and criticised it for that.

US-based rights organisation Human Rights Watch had termed the trial of Nizami case in ICT ‘faulty and biased’ in 2013.

Afroz, however, had refuted the Human Rights Watch allegations at that time.
