Charges of war crimes against Jamaat Nayeb-e-Ameer Subhan

Jamaat-e-Islami leader Abdus Subhan, who is awaiting International Crimes Tribunal verdict on Wednesday, has been charged with nine counts of crimes against humanity, including murder, genocide, abductions, detention, torture and loot.

Charge 1

Subhan, then acting chief of the Jamaat-e-Islami’s Pabna district unit and vice-president of Pabna district Peace Committee, along with his accomplices, took Muazzam Hossain from Ishwardi Central Jam-e Mosque to Ishwardi railway coil depot and stabbed him to death on Apr 17, 1971.

A day later, Subhan and his accomplices abducted Awami League supporter Motaleb Khan and his son Nazmul Huq Khan from the same mosque and took them to Ishwardi railway coil depot where they were tortured to death.

The offences are punishable under Sections 20(2), 4(1) and 4(2) of the ICT Act.

Charge 2

Subhan, Pakistani forces and Biharis attacked Gopalpur and Baghoir villages under the Ishwardi Police Station where they torched houses of Korban Ali and others after looting valuables. They abducted Tulu Khatun, wife of Aijuddin and his son Israil and brother Taizuddin from the house on Apr 13.

He, along with his accomplices, abducted Joynuddin Member, Ahsan Ali Engineer, Rustom Ali, Haras Uddin Pramanik and Ismail Hossain of Juktitola village, and lined up them at gunpoint in front of the Juktitola Govt Primary School. Pakistani army fired at them, killing Joynuddin, Ahsan Ali, Ismail, Haras and Taizuddin. Rustom, Israil, and Tulu survived with severe bullet injuries.

The offences are punishable under Sections 3(2)(a), 3(2)(g), 4(1) and 4(2) of the Act.

Charge 3

Subhan, his accomplices, and Pakistani army torched the houses of Alauddin and Riazuddin Mondal of Aronkhola village after looting valuables in the last week of April.

He and his accomplices abducted Joynuddin and Ansar Commander Alauddin Mia from Aronkhola and confined them for three days in the district council bungalow at Ishwardi on May 16.

The offences are punishable under sections 20(2), 4(1) and 4(2) of the Act.

Charge 4

Subhan and his accomplices prepared on Apr 11 a list of liberation supporters, Hindus and freedom fighters in a plan to kill them. Under his leadership, local Biharis and Pakistani army started an operation on May 2 in Shahpur village to kill the listed people.

In his presence, Pakistani soldiers executed Chand Ali Pramanik, Akhter Pramanik, Anar Pramanik and Hamez Uddin Pramanik.

They also killed Rajob Ali Biswas, his friend Shamsul Huq, Md Ali Sarder and several others of the same village.

During the attack, they looted property from the houses of Chand Ali Pramanik, Principal Toyob Hossain, Rahman Sarder and 10-15 others, and set them on fire.

The crimes are condemnable under sections 3(2)(a), 3(2)(g), 3(2)(h), 20(2), 4(1) and 4(2) of the Act.

Charge 5

Subhan brought around 200 Pakistani Army men to the village Kulnia under the Pabna Sadar Police Station at about 11:00am on May 11 to mount a planned attack on the unarmed villagers. They killed Samjuddin Pramanik and Hasina, the wife of Aminuddin.

Rahaton Nessa, wife of Samjuddin Pramanik, was also badly injured by an Army gunshot and died within a few days.

Later, at noon, Subhan and the Pakistani Army went to neighbouring village, Dogasi. They attacked the house of Horipada Saha, killed Giripada Saha, and set fire to the house and temple of Horipada.
Benu and Horipada were also shot dead by the Pakistani Army on the Dogasi bazaar road.

Finally, Subhan and the Pakistani Army, on the same day, went to Dogasi Paschim Para and killed Chad Ali Pramanik along with some others in the Dogasi Jam-e Mosque, and set Pramanik’s house on fire.

These crimes are punishable under Sections 20 (2) and 4(1) of the Act.

Charge 6

Between 6am to 2pm on May 11, Subhan took 300 Pakistani Army men with the intent to destroy a Bangalee nationalist group and a Hindu religious group, in whole or in part, to the villages of Momrajpur, Kuripara, Tarabaria, Fokitpur, Satbaria, Kandarppur, Sindurpur, Nischintapur, Gupinpur, Harirumpur, Shemnagar, Naruhahi, Singhanagar, Bhatpara and Gupinpur of Satbaria Union under Sujanagar Police Station.

They attacked the villagers and abducted about 400 leaders and workers of the Awami League, Hindus, and supporters of the Liberation War. They killed them in a planned way.

At the time of these atrocities, many houses in those villages were plundered and set on fire by Subhan and the Pakistani Army.

These are crimes punishable under Sections 20(2), 4(1) and 4(2) of the Act.

Charge 7

Subhan led the Pakistani Army to the houses of Rustom Sheikh and others, the field of Bharara High School and Nurpur Power Station of village Bharara under the Sadar Police Station on May 5 and 6.

They systematically killed about 19 people in those places including Abdul Jabber, Siraj Sheikh, Nurul Islam Sheikh, Rustam Sheikh and Abdul Mazidul Sheikh, the sons of the late Gaher Ali Sheikh and others. They also committed abductions and torture.

These crimes are punishable under Sections 20(2), 4(1) and 4(2) of the Act.

Charge 8

Along with some Razakars, Subhan, the then acting chief of Pabna District Jamaat-e-Islami and the vice-president of Pabna District Peace Committee, went to the Razakar’s camp at Dublia bazaar with a vehicle and apprehended Kalimuddin Kha and another person from Gobinda's tea-stall at the bazaar around 2pm on a day in the first week of September, 1971.

They took the apprehended persons to the camp and carried out inhuman torture on them.

They shifted the victims to Pabna in the evening.

On the following day, Subhan and his accomplices took the victims to Radha Gobinda Kali Mandir of village Kuchiamara under Pabna Sadar Police Station and shot them dead there.

Subhan can be punished for the crimes under the Section 20(2), 4(1) and 4(2) of the Act.

Charge 9

Subhan, Khodabox Khan, Moulana Ishaque and 50 to 60 local Razakars went to the villages Betbaria and Ramnathpur under Ishwardi Police Station and attacked the villages from 6am to 10am on Nov 21.

They plundered and set fire to 10 to 12 houses, including those of Shafiuddin Pramanik, Sabed Ali Pramanik, Khabiruddin Sarder and Tofazzal Biswas.

The Jamaat leader and his accomplices also abducted Shafiuddin Pramanik, ‘Bhadu’ and ‘Boyna’ from Betbaria and ‘Osman’ from village Ramnathpur.

They took them to a warehouse at Ishwardi near the house of Moulana Ishaque and confined them there. After three days, they took the victims to Dak Bungalow in front of Ishwardi Police Station.

There, they were tortured to death.
