The same plea was earlier rejected by the High Court.
On Sunday, a five-member Appellate Division bench led by Chief Justice Surendra Kumar Sinha turned down the BNP chief’s fresh prayer.
The plaintiff would now be cross-examined at a special court in Dhaka on Mar 3, Khurshid Alam, counsel for Anti-Corruption Commission (ACC), told bdnews24.com after the judgment.
AJ Mohammad Ali represented Khaleda Zia in court.
The ACC in 2008 filed the case against six, including the BNP chairperson and her son Tarique Rahman.
It alleged that the defendants misappropriated Tk 21 million from funds meant for the trust, after the amount was transferred from a foreign bank.
The chargesheet in the case was submitted in August 2010 and a special judge’s court in Dhaka began the trial proceedings in March 2014.
In 2011, the anti-corruption watchdog in another case accused the BNP chief and three others of embezzling Tk 31.5 million of the Zia Charitable Trust.
With Khaleda repeatedly skipping court appearance, the court recorded the plaintiff’s testimonies over five days in her absence.
On Jun 15 last year, she moved the High Court seeking fresh plaintiff testimonies in the case.
The bench of Justice Md Moinul Islam Chowdhury and Justice JBM Hassan turned down the plea on Jun 29.
Khaleda then went to the Appellate Division on Sep 16 last year for the same but now she has been rejected by it as well.
Earlier, the former prime minister had challenged the legality of her indictment and of the recruitment of the judge who framed charges against her. But both the appeals were rejected.
