His advice came on Monday amid a controversy surrounding a statement made by the chief justice.

Surendra Kumar had said that the writing of verdicts by judges who had gone into retirement was  ‘unconstitutional’.

Sengupta, who was involved in the formulation of Bangladesh’s Constitution, thinks Sinha has gone beyond his jurisdiction by making the statement.

He felt the chief justice had ‘created tension by making public an internal row of the judiciary’.

“Holding the office (of the chief justice), he made that has created tension in national politics. That is unacceptable,” said Sengupta.

Speaking at a discussion at Shilpakala Academy, the ruling party leader said the chief justice had gone beyond his limit with his words.

He said the Constitution does not endorse the statement of justice Sinha.

“I drafted the Constitution. Nowhere in the Constitution is it written that justices can’t write judgments after going on retirement,” he added.
