SC to decide on Fakhrul bail in three violence-related case on Sunday

The Supreme Court will give its verdict on Sunday on whether the bail of BNP leader Mirza Fakhrul Islam Alamgir in three violence-related cases is tenable or not.

A four-member Appellate Division bench, headed by Chief Justice Surendra Kumar Sinha, on Thursday fixed the date after hearing the state plea against the High Court bail for the BNP’s acting secretary general. 

Khandker Mahbub Hossain, Zainul Abedin and Sagir Hossain Leon argued for Fakhrul while Attorney General Mahbubey Alam represented the state.

High Court granted the interim bail on June 21 in the cases filed with Paltan police.

After the state challenged the verdict before Chamber Judge Justice Hasan Foez Siddique on June 29, he forwarded it for a regular hearing at the Appellate Division bench.

On June 28, Appellate Division upheld the High Court bail of the BNP leader in three other cases of violences filed with Paltan and Motijheel police over vandalism, arson attacks on cars, and bombing during protests.

Fakhrul, shown arrested in seven cases over violence after his detention six months ago, is now undergoing treatment at the Bangabandhu Sheikh Mujib Medical University.

He was picked up by police after a media briefing in the National Press Club during the BNP agitation to mark the first anniversary of the 10th National Elections through which the incumbent Awami League government continued in power.

BNP had boycotted the polls citing ‘lack of credibility’ of the Election Commission which it said was biased towards Awami League and demanded holding polls under a non-partisan government.

His lawyers moved the High Court after not getting bail in these cases at the trial courts. He got interim bail in one of them for six months on Apr 16.

On June 18, High Court also granted him interim bail in three other cases until the police file their report. The state moved the Appellate Division against it but the bail was upheld on June 28.

Fakhrul was moved to BSMMU from Kashimpur Prison on June 13 on medical grounds.
