SC upholds HC bail for BNP leader Mirza Fakhrul

The Supreme Court has upheld the High Court’s order granting bail to BNP leader Mirza Fakhrul Islam Alamgir in three violence-related cases.

A four-member Appellate Division bench, headed by Chief Justice Surendra Kumar Sinha, granted the BNP leader bail until police filed their report on the three cases on Sunday.   
 
Now, there was no bar to the BNP acting secretary general’s release as he had already been bailed in four other cases by the High Court, his lawyer Sagir Hossain Leon said after the Appellate Division order.
 
The state moved the Supreme Court, seeking a stay on the High Court’s bail order for Fakhrul in the three cases filed with the Paltan and Motijheel police stations over vandalism, arson attacks on cars, and bombing during protests.

In the hearing on the state plea, Leon, Khandker Mahbub Hossain and Zainul Abedin stood for Fakhrul.

Attorney General Mahbubey Alam, his deputy Ekramul Haque Tutul, and Additional Attorneys General Murad Reza and Momtaz Uddin Fakir argued for the state.

Tutul told bdnews24.com after the order that the BNP leader will have to surrender to the judicial court after police submit the investigation report.

Fakhrul, shown arrested in seven cases over violence after his detention six months ago, is now undergoing treatment at the Bangabandhu Sheikh Mujib Medical University.

He appealed to the High Court for release after getting bail in all the cases from judicial courts.

On June 18, the High Court granted him bail until the submission of police report in the three cases.

The state had the scope to appeal against the bail ordered by the High Court in three other cases on June 21.
