Hearing on plea seeking stay on Fakhrul’s bail on June 25

The chamber judge has referred prosecution’s plea for a stay on the High Court order granting bail to BNP leader Mirza Fakhrul Islam Alamgir in three cases over vandalism to the regular bench of the Appellate Division.

The prosecution on Monday appealed to Chamber Judge Hasan Foez Siddique for a stay order, but without entertaining the plea he referred the petition to the regular Appellate Division bench for hearing on June 25. 

A High Court bench on Thursday granted interim bail to BNP acting Secretary General Fakhrul in the cases.

Two of the cases are registered with Paltan police and one with Motijheel police over vandalism and arson.

Earlier on Sunday, he secured bail from the High Court in three other cases filed with the Paltan Police Station.

After the bail orders BNP leaders had said there were no obstacles to the release of Fakhrul, who is in prison for six months.

State attorneys moved the chamber judge seeking a stay order.

Attorney General Mahbubey Alam and Additional Attorney General Murad Reza represented the state in the hearing at the chamber judge’s court.

Khandaker Mahbub Hossain, Zainul Abedin and Mahbub Uddin Khokon represented Fakhrul.

Khokon told bdnews24.com: “State lawyers appealed for a stay order on the bail, but the chamber judge has sent the petition to the regular Appellate Division bench for hearing, without staying the bail.”

Fakhrul is now undergoing treatment at Bangabandhu Sheikh Mujib Medical University where he was shifted by the jail authorities a week ago following a High Court order.

The three cases

Law enforcers filed a case against the BNP leader with Paltan police on Jan 4 this year on charges of vandalising vehicles.

Another case was filed with Motijheel police on the same day for arson attacks on vehicles and crude bomb explosion.

The third case was filed with Paltan police on Dec 29 last year over arson attacks and hand bomb explosion.
