The High Court bench of Justices Naima Haider and Md Iqbal Kabir gave the order after hearing a plea by Fakhrul’s wife Rahat Ara Begum on Tuesday.

The court also issued a rule asking why the ‘inactiveness’ to admit Fakhrul to the hospital should not be declared illegal.

Home secretary, IG (prison), DIG (prison), Dhaka DC, Kashimpur Jail’s jailor, and deputy jailor were made party to the rule.

The court had asked them to respond to the rule within four weeks, Barrister AKM Ehsanur Rahman said.

Ehsanur Rahman said the BNP leader was arrested onJan 7.

He has secured bail in one out of the seven cases filed against him. Hearing on three other cases is awaited while other three cases are awaiting hearing in the upper court.

“He (Mirza Fakhrul) has been suffering from high blood pressure and diabetes. Earlier, he had a minor attack. This is why this writ petition has been filed,” Ehsanur Rahman said.

During the BNP-led alliance’s, the BNP senior leader was arrested on Jan 6, when he was leaving the National Press Club, in a case over violence. He was sent to Kashimpur jail on Jan 8.

After his arrest, he had been taken to BSMMU twice for treatment.

Recently, on May 5 he was taken to the hospital where a six-strong medical board conducted some tests on him and declared his physical condition as ‘stable.
