HC rule asks why inmates held without trial should not get bail

The High Court has asked why eight persons detained without trial for more than a decade should not be granted bail.

The bench of Justices AKM Abdul Hakim and SM Mojibur Rahman issued the rule on Tuesday and ordered the case documents be submitted before the court.

The bench ordered the concerned district magistrates to respond to the rule within 15 days.

Supreme Court Legal Aid Panel Lawyer Chanchal Kumar Biswas brought the matter of the long detentions without trial of the inmates at the Sylhet, Satkhira, Bagerhat, Kishoreganj, Narsingdi and Munshiganj jails to the High Court's notice on Monday. 

“The court issued a rule after a preliminary hearing after I brought the issue to their attention yesterday (Monday),” he told bdnews24.com. “The HC has ordered prison authorities to bring the inmates before them, but has not specified a date or time as yet. It may do so soon.”

The eight inmates

<<Md Jalal, 51, hails from South Pawser village in Munshiganj’s Shirajdikhan and has been in jail for 14 years. He is accused of murder and is yet to be tried by the Munshiganj District and Sessions Judge’s Court

>>Shaju Miah, 45, hails from Chainparha in Narayanganj’s Arhaiparha and has been in prison for 10 years. A murder case against him has not yet been tried by the Narsingdi District and Sessions Judge’s Court

>>Md Takdir Miah, 35, who hails from West Tenguri village in Kishoreganj has been in prsion for over 10 years. The murder case against him has been held up at the Kishoreganj Additional Sessions Judge’s Court – 3

>>Ashim Haldar, who hails from Bagerhat, has been in prison for 10 years. A murder case is pending against him at Bagerhat Police Station and is under the jurisdiction of the Bagerhat Additional Sessions Judge’s Court – 1

>>’Asadul’ aka ‘Assa’ hails from Dohar village in Satkhira’s Tala Upazila and has been in prison for 10 years. The murder case against him is under the jurisdiction of the Satkhira District and Sessions Judge’s Court

>>Md Dana Miah, 55, hails from Charlapang in Brahmanbarhia’s Nabinagar and has spent ten years in jail over a murder case. His case is before the Sylhet Additional District and Sessions Judge’s Court. Miah has been brought to court 81 times without trial

>>Saiful Alam aka ‘Belal’, who hails from Bade Pasha village in Sylhet’s Gopalganj, has been in prison for 10 years and five months. He was arrested over a murder case and two other criminal cases. Belal’s case is assigned to the Sylhet Additional District and Sessions Judge’s Court – 4.  He has been brought to court 87 times without trial
