High Court denies rape suspect bail, sends him to police custody

The High Court has sent a rape suspect to police custody when he surrendered and sought preemptive bail over a case started in Comilla.

The bench of Justices Sheikh Abdul Awal and Shahidul Karim rejected the bail petition of Md Nayan Mia.
 
Nayan’s lawyer moved the petition on Tuesday to secure bail in a case initiated under the Women and Children Repression Prevention Act in a court in Comilla on Jul 27 this year. 
 
The case is now under trial in the Senior Judicial Magistrate’s Court in Comilla.
 
At the bail hearing, Deputy Attorney General FR Khan objected to the petition saying that ‘there are specific charges against the suspect and the case is under trial in the lower court’.
 
So, in this circumstance, it would not be wise for the court to grant him bail.
 
The bench agreed with the DAG’s submission.
 
Advocated Harun Or Rashid moved the petition on behalf of the accused.
