Supreme Court vacation judge Hasan Foez Siddique has sent the case for hearing to the Appeals bench after hearing the representation of Khaleda Zia's lawyers.

AJ Mohammed Ali, Barrister Ragib Rauf Choudhury and Zakir Hossain Bhuiyan represented Khaleda while Khurshid Alam Khan argued for the Anti Corruption Commission (ACC).

"The leave-to-appeal petition is aimed at staying the case in the lower court. 31 July is now fixed at the date for regular hearing on this," Khurshid Alam Khan said.

The ACC filed the Niko graft case against Khaleda during the military-backed caretaker regime on Dec 9, 2007.

Charges will be framed in this case on Monday in the court of Special Judge-9. "So now there is no legal hurdle to hear the case," Khan said.

But Barrister Ragib differed with Khan and said that it was not legal to have a hearing in a lower court on the case since it was up for hearing in the leave-to-appeal petition in the higher court.
