The four-member Appellate Division bench led by Chief Justice SK Sinha gave the decision on Thursday.

After hearing a petition by Minar on Monday, the High Court bench led by Justice Muhammad Abdul Hafiz granted him bail.

The bail order was stayed until Thursday on a petition by the state.

Feni’s Phulgazi Upazila chairman Ekram was killed in a daylight attack on May 20 last year when his convoy was waylaid.

His brother filed a murder case the same day, naming Minar as the prime suspect and accusing around 35 others unidentified.

On May 27, 2014, police arrested Minar from Dhaka and sent him to Feni jail on June 4 after interrogating him.

He was released after the High Court granted a six-month bail on July 17 upon health grounds.

Later, the Appellate Division scrapped the bail and ordered him to surrender in the trial court.

Meanwhile, Feni police submitted the chargesheet in the case naming Minar as the main accused.

As Minar ignored the order to surrender, a Feni court issued a warrant and the Adabar police arrested him from a Dhaka hospital on Sept 21.

He landed in jail afterwards.
